These terms govern your use of hercreate.com and your purchase and use of HerCreate products. By buying from us or using this site, you agree to them.

1. Who you are contracting with

HerCreate sells its products through Paddle.com Market Ltd and/or Verifone (2Checkout), who act as the Merchant of Record for all orders.

• Your payment contract is with the Merchant of Record.
• Your product licence is granted by HerCreate under these terms.
• Sales tax, VAT, and GST are calculated, collected, and remitted by the Merchant of Record.
• Your statement descriptor will read PADDLE.NET* HERCREATE or 2CO.COM*HERCREATE.

The Merchant of Record's own buyer terms apply to the payment transaction and are available at their websites.

2. What we sell — and what we do not

HerCreate creates and sells digital products only. Everything on this site is downloadable. Our product categories are:

WordPress products

• Divi child themes and Divi layout packs
• Elementor templates, kits, and section libraries
• Block themes and Gutenberg patterns
• WordPress plugins and child themes
• Section templates and page templates

Design products

• Canva templates and template links
• Figma files and UI kits
• Brand kits, logo suites, and colour systems
• Social media template sets
• Icon packs and graphic assets

Written products

• Guides, checklists, workbooks, and ebooks (PDF)
• Documentation and setup manuals

For the avoidance of doubt:

• We do not sell services of any kind. We do not offer custom design, website build, installation, setup, migration, consulting, coaching, or done-for-you work.
• We do not operate a marketplace. Every product on this site is created in-house by HerCreate. We do not host, sell, or facilitate the sale of products by third-party sellers.
• We do not sell physical goods, gift cards, store credit, vouchers, or access to a paid community.
• We do not resell products created by others.
• We make no representation, promise, or guarantee about earnings, revenue, traffic, rankings, or business results. Our products are design files. What you build with them is your work.

3. Accounts

You must provide accurate information and keep your password confidential. You are responsible for activity under your account. Tell us immediately at support@hercreate.com if you suspect unauthorised access.

You must be at least 16 years old, and old enough to form a binding contract where you live.

4. Licensing

Our products contain three kinds of material, and each is licensed differently. Read all three.

4.1 GPL-licensed code

All PHP code in our WordPress themes, child themes, plugins, and block patterns is licensed under the GNU General Public License, version 2 or later (https://www.gnu.org/licenses/gpl.html).

This is not a choice. WordPress is GPL, the Divi theme is GPL, and Elementor is GPLv3. PHP that derives from any of them inherits the licence. We publish under "version 2 or later" so that our code remains compatible with both Divi and Elementor.

You may copy, modify, and redistribute those PHP components under the terms of the GPL.

4.2 Layout and template data files

Divi layout JSON exports, Elementor kit and template JSON exports, and equivalent builder export files are data, not executable code, and are not derivative works of the builder's source code. HerCreate licenses these files to you under the proprietary terms in 4.4, not under the GPL.

We note in good faith that the licence status of builder export files has not been settled by a court. This is our position and the prevailing position in the WordPress template industry.

4.3 Proprietary components

All other material is not GPL and remains the exclusive property of HerCreate:

• Images, photographs, illustrations, icons, and graphics
• CSS and JavaScript files
• Canva templates and Canva template links
• Figma files and UI kits
• Brand kits, logo files, and colour palettes
• PDFs, guides, checklists, and written content
• Documentation and setup guides
• The HerCreate name, logo, and trade dress

These are licensed to you, not sold.

4.4 What your licence permits

Subject to payment and to your licence tier:

• Single site — use on one live website that you own, or that you build for one client.
• Three sites — use on up to three live websites.
• Unlimited sites — use on any number of live websites you own or build for clients.
• The Suite — use of any product in the library, on unlimited sites, while your membership is active.

Development, staging, and local sites do not count against your limit.

For non-website products — Canva templates, Figma files, brand kits, social sets, PDFs — a licence permits unlimited use within your own business, and use in work delivered to clients, subject to 4.5.

4.5 What your licence prohibits

You may not:

• Resell, redistribute, sublicense, or give away the proprietary components or the builder export files of any product.
• Repackage any product, in whole or in part, into a theme, template, kit, course, or product that you sell or distribute.
• Upload our products to any marketplace, template library, membership site, or file-sharing service.
• Resell, share, or transfer a licence key. Keys found active across multiple accounts will be deactivated without refund.
• Extract fonts, photographs, icons, or illustrations from our products for use outside them, unless the underlying asset licence permits it.
• Claim ownership or authorship of our products.
• Use our products in material that is unlawful, defamatory, hateful, sexually explicit, or that infringes the rights of others.

Delivering a client a finished website or design built with our product is permitted. Delivering the client the source files to reuse elsewhere is not, unless they hold their own licence.

5. The Suite

The Suite — Annual is a subscription. It renews automatically each year on the anniversary of your purchase, at the price published at the time of renewal. A reminder is sent before each billing date. You may cancel at any time, in one click, from your account. Cancelling stops the next charge; it does not refund the current period.

The Suite — Lifetime is a single, non-recurring charge. It grants a perpetual licence to every product in the library at the time of purchase, plus every product released afterwards, for as long as HerCreate continues to operate and actively sell the products. There is no renewal and no further charge.

"Lifetime" refers to the operational lifetime of HerCreate and its products, not to your natural lifetime. If HerCreate ceases trading, is acquired, or discontinues a product line, the files you have already downloaded remain licensed to you permanently, but no further releases will be provided.

In every case: files you download while your membership is active remain yours to keep and use under these terms, permanently, whether or not your membership continues.

6. Delivery

Files are delivered instantly. After payment is processed you will receive an email containing your order number and access details, and the files will be available in your account.

If the email does not arrive, check your spam folder, then contact support@hercreate.com. Re-download access is available for as long as your licence key is valid.

7. Support and updates

Support is provided by email, in English, to holders of a valid, active licence.

• Single purchases: support and updates for 12 months from the date of purchase.
• The Suite — Annual: support and updates while the membership is active.
• The Suite — Lifetime: updates for the lifetime of the product, as defined in section 5. Support for 12 months from purchase, extendable by purchasing additional support.

We aim to answer every enquiry, but we do not guarantee that any particular question can be resolved, or resolved within a timeframe you find satisfactory.

We are not obliged to provide support where the problem is caused by third-party plugins, themes, page builders, hosting environments, or modifications you have made to our files.

8. Third-party requirements and trademarks

Our WordPress products require WordPress, and depending on the product, a specific page builder. Each product page states its requirements. Where a third-party theme or plugin is required, it must be purchased or obtained separately by you; it is not included in your purchase and we do not resell it.

• Divi, Extra, and Elegant Themes are trademarks of Elegant Themes, Inc. HerCreate is not affiliated with, endorsed by, or sponsored by Elegant Themes, Inc.
• Elementor is a trademark of Elementor Ltd. HerCreate is not affiliated with, endorsed by, or sponsored by Elementor Ltd.
• Canva is a trademark of Canva Pty Ltd. Figma is a trademark of Figma, Inc. HerCreate is not affiliated with either.

All trademarks are used descriptively, to identify compatibility.

9. Intellectual property warranty

Every product sold by HerCreate is created by HerCreate. All fonts, photographs, icons, and assets bundled in our products are either original, in the public domain, or licensed to us with the right to redistribute them within a template. We do not resell third-party products.

Where a bundled font, photograph, or asset carries its own licence, that licence is included in the product download and governs your use of that asset.

If you believe any HerCreate product infringes your copyright, email legal@hercreate.com with details and we will investigate and act promptly.

10. Prices and changes

Prices are subject to change without notice. A price change never affects a purchase already completed. Renewal prices for The Suite — Annual are the prices published at the time of renewal, and we will notify you before any increase takes effect.

We may modify, improve, or discontinue any product at any time.

11. Warranty disclaimer

Our products are provided "as is", without warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

Our WordPress products are guaranteed only to function on a clean, current, stable installation of WordPress and the required page builder. Given the number of plugins, themes, builders, hosts, and browsers in existence, we cannot and do not guarantee compatibility with all of them.

Our Canva and Figma products are guaranteed to open in the current version of the respective application.

12. Limitation of liability

To the fullest extent permitted by law, HerCreate is not liable for any indirect, incidental, special, or consequential damages, or for loss of profits, revenue, data, business, opportunities, customers, or goodwill, arising from the use of or inability to use our products.

Our total aggregate liability to you, for any claim arising out of these terms or our products, is limited to the amount you paid us in the twelve months preceding the claim.

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded.

13. Termination

We may suspend or terminate your account and deactivate your licence keys, without refund, if you materially breach these terms — in particular by redistributing proprietary components or builder export files, reselling licence keys, or filing a chargeback without first contacting us.

You may close your account at any time. Files you have already downloaded remain licensed to you under section 4.

14. Refunds

Our Refund Policy forms part of these terms and is available at hercreate.com/refund-policy. In summary: full refund within 30 days, no questions asked; renewals and requests after 30 days are not refundable.

15. Email

We may send you transactional emails relating to your purchase — receipts, licence keys, renewal reminders, and security notices. These are not marketing and cannot be unsubscribed from while you hold an active licence.

Marketing emails require your consent and can be unsubscribed from at any time, without penalty.

16. Governing law

These terms are governed by the laws of Bangladesh, and the courts of Bangladesh have exclusive jurisdiction, except that:

• Nothing here deprives you of the protection of the mandatory consumer law of the country in which you habitually reside; and
• Consumers in the European Union and United Kingdom may bring proceedings in their own courts.

17. Severability

If any provision of these terms is held unenforceable or invalid, that provision is severed and the remainder stays in force.

18. Changes to these terms

We may revise these terms. The version in effect at the time of your purchase governs that purchase. Material changes are announced by email to registered users. Continued use of the site after a change constitutes acceptance.
